    hi,
    My lawyer filed for my EAD in April 2005. I have been working on H1 all the time and i was not aware that he filed for my EAD.
    HE filed for my AP at the same time and i got it. When i asked him about EAD , he said its not required and that he did not file it.

    Yesterday he mailed me a set of copies in which i found receipt notice for EAD.I checked the status and it says that my case is pending since April 2005.
    There was no request for any proof or anything. It just says we mailed you notice of action and the case is pending.

    I need EAD now. What should i do?

    I called the USCIS and they said that it is out of processing time and filed a service request.

    All my friends who filed their I-485 recently got their Biometrics notice and i didn't get any. Whats wrong with my case?

    I am confused , what am i supposed to do?

    It was on Dec 2005 . Luftansa . Chennai - Frankfurt- Dallas . I was waiting for my boarding pass . I handed over my e ticket to the lady at the counter. Instead of issuing the boarding pass , she asked me about my H1B papers. I got confused . Why should I show my papers to this lady ? . Since it was my very first trip to US , I meekly showed her my papers.After that she had issued the boarding pass.

    Friends, you may think I am very meek.This was not my first overseas trip. I had visited Japan previously. I didn't want to have fight with her and start my journey in bitter taste from the beginning.

    Don't think only Non-Indians treat Indians shabbily. Our enemy is within.

    If I happened to see that lady once again in Chennai -------

    There are a lot of interpretations. Popular Attorneys like Rajiv Khanna and Sheela Murthy claim it is not valid and always advise clients to have a h1b backup. Not sure why they are so keen on h1b. It could be because some adjudicators may send EAD revocations also along with 485 denials.

    Chandu, they may have other good reasons to do so, but one advantage for attorneys is an added fees out of filling for H1B; and for employers is less employee turnover due to the fact that even if employee is willing to change jobs. It is not so easy to find next job with H1 sponsorship than to be able to find one on EAD :)

    some tips from Susan Henner:

    Although the principal employment-based categories are current for
    July,
    future retrogression is indeed possible later this fiscal year,
    particularly
    if demand for immigrant visas increases substantially. Visa numbers
    can
    retrogress in the middle of a month and become unavailable without any
    prior
    notice. If there is a mid-month retrogression, USCIS could elect to
    stop
    accepting adjustment applications. While this is unlikely to occur in
    July
    2007, it becomes more and more possible as the fiscal year progresses.


    It seems that cases not completed before any future retrogression will
    be
    held in abeyance until priority dates again become current. Having an
    adjustment on file, even if the case is in abeyance, allows for
    eligibility
    of work authorization and advance parole, and may be particularly
    critical
    in circumstances where there are children who may reach the age of 21
    during
    the process.

    An applicant for adjustment of status MUST be in the United States in
    order
    to be eligible to file. Overseas spouses of adjustment applicants
    should
    be encouraged to enter or reenter the United States as soon as possible
    in
    order to be included in the principal's adjustment application.


    H-1B and L-1 nonimmigrants may maintain H or L status while their
    adjustment
    of status applications remain pending.

    Whenever possible an adjustment application should be filed
    concurrently
    with an I-140. This is permitted as long as the visa priority date is
    current. Even if priority dates retrogress after filing, the I-485
    will be
    placed in abeyance and remain pending, although it cannot be approved
    until
    the priority date is current again. Yet extensions of work
    authorization
    and advance parole may be obtained during this period.

    It may be advisable to file I-140s by premium processing if available
    for
    the employment-based immigrant category. This may hasten the issuance
    of an
    approval and may also increase the possibility that an adjustment
    application could be approved and an immigrant visa number captured
    prior to
    the end of the current fiscal year or before any future visa
    retrogression.

    I had a reqruiter discussing a great job opportunity and finally when it came to the status thing, it was my mistake, i said "I have EAD". She said "That's fine" and never got back to me, she said she will be in touch via email but never did that.

    So this is a pattern now.

    Reqruiters and HR know they can say "Sorry we do not sponser visas" so they say it without any issue but not EAD.

    I am just baffled as to why are some people so fussy about EAD. Isn't EAD holders a piece of cake for the company? People with skills and eligible to work for any employer????

    I am sure the hiring managers would love to bring good people on board. But unfortunately, these reqruiters and HR are creating the mess.

    Looks like for reqruiters, they think they can just apply the filter to lessen their burden on collecting resumes.

    The problem here is, she may not have responded back for some other reason. We cannot assume the EAD is always the reason. We cannot know unless they explicity say so, as I experienced yesterday.

    My wife had her resume on monster under the GC cateogry (they do not have an EAD category as far as I know). She was interviewed and selected and when submitting her I-9, she put in her EAD details and attached a copy. No one raised a hoot at any point.

    There are only some sections rejecting EADs either because of ignorance or due to the additional work required in screening EAD candidates as the recruiter explained to me.

    It may also be a good idea for people who recently had success with EADs to post their cases here or people will begin to get anxious about their work status as no one really knows how long they will be stuck with EADs.

    My experience with British Airways back in 2004 was actually quite good. My flight to Delhi was delayed by 12 hours. I approached a BA agent, and he helped me get a 24 hr UK visa to leave the airport, a hotel room at the airport, and meal coupons. I was traveling on Indian passport with a valid unexpired H1B visa stamp (the agent did tell me that he was able to do all this for me since I had an unexpired US visa).

    I was in a similar situation in 2003 travelling with Air France, and they refused to extend any help whatsover. I didn't have an unexpired US visa in my passport at that time. I have heard from others who've had good experiences with Air France.

    I guess one's experience with an airline completely depends on the prevailing circumstances, the specific service agents, and one's own level of patience and tolerance. Its hard to characterize any one airline as particularly good or particularly bad.

    However, having an unexpired US visa in one's passport definitely puts one is a better position to negotiate in difficult circumstances. I guess the prevailing opinion among several of these European transit countries is that if you have a valid unexpired US visa, you are less likely to cause trouble or seek asylum in their country.

    I also did send a second set on August 16th.For me and family we have already got EADs,AP and AOS receipts and are all finger printed.
    I have also requested stop payments on the August checks,and had addressed"not to be opened in Mailroom-for Center Director" Explained to disregard the second set if my earlier filing on July2nd has already been accepted for processing.So far no further info.Will keep fingers crossed and see what happens!

    Congrats. Enjoy the freedom after 14 years struggle.

    Finally got the CPO emails/texts today morning for both me and my wife.

    Came to USA in 1996 on H1. Masters (F1) from 1999-2000.
    All GC applications in EB2. Nationality : India.
    Applied in Mid 2001 : company (think $15B!!!) went kaput.
    Applied in Mid 2003 : I quit in mid-2005 - while labor pending.
    Applied Nov 22, 2005 : Approved Aug 11, 2010.

    Labor applied via PERM - approved in about 4 months.
    I-140 applied soon after - approved in about 4 months.
    I-485 applied during the July-August 2007.
    Receipt Date: Aug 16, 2007
    Notice Date: Oct 1, 2007
    At NSC.

    Quit in mid-2008 with 485/EAD, sent AC21.
    Got RFE in Sep 2008 (missed the 2008 boat).
    485 LUD stuck at 10/29/2008 forever until today.

    Opened a SR on Aug 5th.
    Took an infopass on Aug 6th - all I could get was, "your application is with an
    Immigration Officer since Aug 2nd". Nothing else!
    Don't know if either had an effect.
    Didn't do anything beyond the above two.

    I think anything that's helpful for anyone based on dates/apps/process/procedures are all listed above. Now for a bit of something in my mind. No particular theme but general rambling....if you so indulge..please continue. Else Have a good day and happy life. And thanks IV.

    It has been a long journey for sure. A lot of my friends who came to
    USA in 1996 are now citizens. I have NO regrets at all. I took my own
    path. Sometimes I used to think that if I had done the GC process
    in 1998/1999 instead of quitting my full time job to do full time masters,
    I might've gotten GC sooner. OR what if I had stuck with the 2003 application,
    sure, it would've taken longer to get even the Labor cleared but I would
    have gotten GC in probably 2007 - and worst case 2008. And heck, I would
    have made an additional $150K (since the company got acquired by "as big
    as it gets" tech company). OR what if I had chosen a very safe choice out
    of masters [believe it or not, I got 12 offers back in 2000 - but then heck,
    every body else got 12 offers as well]. OH btw, the full time masters ended
    up costing me about $45K in credit card loans. So yeah...no point in contemplating
    all the "coulda woulda shoulda"s in life.

    As Nike says: Just do it.

    I strongly believe it was because of the masters that I got the first 2000/2001 company, I got into the next job - and because of it to the next one and because
    of that to the current one - where I am extremely happy and think
    will over time come out very well off too.

    At all times, I never compromised on my job. Took the job which offered
    me the most challenge and allowed me to learn as much as possible while
    working the smartest folks around. That I think was a great benefit - all
    along - since that component of life (work) never bothered me. And was never
    afraid of taking (apparent) risks either. To me they were calculated risks.
    The 2002 company I joined, it was a small startup - I was employee number 20-something and was the only H1-B until we had about 150+ employees.
    When I quit it was 450+ folks and was about 750+ when it was acquired.
    The company I joined in 2008 (via AC21), was and still is a startup. When
    I joined we were 8 employees and still now, remain lean-and-mean but
    kicking some serious ass. (if I say so myself..pardon me). :)

    The biggest hiccup as I think of it now was that my wife was not able
    to work from 2003-2007. But the EAD in mid-2007 finally solved that
    problem. Oh, I never hesitated traveling either : travel to Africa (three
    countries) one year, and to Europe (three countries) one year and
    Asia (two countries other than India) in one year.
    Also purchased a home in 2009 (it was very tempting during the
    2004-2006 times...but waited out for good).

    So yeah...H1-B/EAD/AP are all handicaps - only if you convince yourself so.

    A couple of times I had contemplated Canadian PR or really
    moving there or to somewhere in Europe (and even Aus PR).
    But pursued nothing mostly because I was lazy.

    But all along my wife fully supported in everything I (we) did.
    Be it change of jobs, other big decisions..what not.
    So thankful to god for that.

    Just a bit to go back in the way back machine.
    Long ago, labor was the bottle-neck. Then 485, then something else.
    Things repeat - old is new, new is old...repeat.
    There were times when there was no online checking, no sms, no email notifications.
    Six year h1-cap was strongly enforced. no concurrent 140/485. No one year extension of h1. No 3 year extenstions of h1 after 140. No 2 year EADs. No AC21. No priority date porting. I can go on....but a lot of stuff happened...happens.

    If there is one thing I learned wrt immigration, it is do things ASAP. Never postpone anything at all. As much as possible get first in the queue.

    A general piece of advice: Never reject an option you don't have. [this is more to do with folks who say, "I am only in year 1 in h1..I don't know if I need gc..let me see after 2-3 years.." - guess what einstein, it is easy to give up your gc after you get it, then to get it when you desperately need it.]

    EB2-IC seems in pretty good shape as far as I can tell.
    EB3-folks need some serious legislative help - please consider contributing a fraction of what you send for your immigration-lawyers and get something done. support IV.

    Collected from some other forum . Just google search your name combinations ( within quotes ).

    For eg. if you have FirstName MiddleName LastName .

    The search should be ( put within quotes )

    "FirstName MiddleName"
    "FirstName LastName"
    "MiddleName LastName"

    and all the reverse combinations.

    If you get hits in 100s or 1000s , yeah you can wait 2 -3 years.
    This is observed from the names of Indians.

    well this is great news there were no hits for my husbands name and only 1 hit for my name! Hopefully we will be ok and not get stuck in name checks then! Thank you for your response!

    U are saying - The person's GC category should be same all through out the GC process, irrespective of the technical advancements the person make during the course of the GC process. A person is porting only because he is qualified for the category, U folks are talking as if there is an open slot and everyone is clamoring for it.

    U'r logic should be similar to the below scenario..

    A person joins a company as a Jr. Engineer, then based on U'r logic he/she cannot become a Manager (which requires an MBA / equivalent) because he entered the workforce as a Jr. Engg. Even though the fellow would've acquired necessary skills and even MBA (going part-time to school), still he/she cannot become a Manager. U are vouching that an MBA who joined few months earlier can become the Manager but not the home groomed fellow. Wow, U'r logic seems to a ground breaking thought process, please extrapolate U'r lawsuit for the case mentioned above. If you win, this might be the most ground breaking decision in US.

    Personally I've reported to folks who joined company as high-school grads and worked their way up to Managerial position ofcoz acquiring the necessary college education while working. They have shown up those experience to move ahead of other folks who joined later with higher degrees.

    Rather than focusing on divisive efforts why can't you focus on real problem - retrogression. Why don't you work towards IV's goals? You folks joined the forum few months back and have already made great impact. Hope you would channel U'r energy into something positive for the entire community.

    I got fired last April. I had my I-140 approved. Employer HR told me will not withdraw I-140 but cannot give me employer letter. How should I proceed with filing I-485? Please help.

    I have seen some posts that suggest using paystubs but this is tricky for you since you won't have anything recent since last April. One gamble would be to file and hope you get an RFE after 6 months when you can get a letter from a new employer ie AC21. However USCIS is warning that they will reject applications if the 'initial evidence' is missing. Do you have a new LC? If so, you could file I-140 premium processing and keep your original PD. Is your former employer willing to re-employ you in the future (assuming your job loss was related to the employer's financial issues) ?? You likely will need a lawyer to work around the hurdles you are facing.
