Folks,
I got a call from the Ombudsman Office today morning was told that my case is in "transit". When is asked her what it means she told it is going to be reviewed by an IO. I got the similar response to my SR that "your case is pending adjudication by IO" so don't know what to make out of it in the sense that its been removed from the shelf and sitting in some pile and IO will get to it when he/she can?
Did any one get their GC approved after their case was in transit? How long did it take?

Does anyone know how long this process takes (from online app to visa stamped)? I just filled in my app online on wednesday hoping to finish it off on the weekend. Now their site is down for maintenance until monday.

I am not an expert but I have a hunch that EB2 India will progress to Jun 1 2006.
Based on your calculations , Experts, please let us know what to expect, if 12000 GC are released for EB2. Where will the cutoff come and stop..

A Floral Protest Over Job-Based Visas by Nina Bernstein
In a Gandhi-inspired protest, foreigners working legally in the United States sent thousands of flowers to a top immigration official yesterday to draw attention to their complaints about job-based visas.
The official, Emilio Gonzalez, director of Citizenship and Immigration Services, arranged for trucks to haul the bouquets of roses, carnations and other flowers to Walter Reed Army Medical Center in Washington and the National Naval Medical Center at Bethesda, Md.
“The reaction from the patients, family and staff was overwhelming,” said Michael Briggs, an American Red Cross employee at Walter Reed who helped distribute the flowers. “They were very appreciative, and they were excited.”
The flower protest was staged by temporary workers, many from India, who felt jilted by the immigration agency’s decision last week to withdraw tens of thousands of job-based visas. The State Department announced last month that green cards would be available starting July 2 for applicants across the range of high-skilled categories, but the immigration agency later said there had been a misunderstanding and no visas would be available.
With a more typically American form of protest under way in the courts — the first lawsuits over the about-face were filed last week — an agency spokesman, Dan Kane, would not discuss the complaints behind the flowers.
Vikas Chowdhry, a software developer who helped coordinate the protest, said the flowers had served a good purpose.
“We are overjoyed that these flowers brightened the day of our injured service brethren,” Mr. Chowdhry said. “It is their sacrifice for American freedom that has made this country great and such a desirable destination.”

my 485 was filed during Aug 2007 , i had EAD as well that i never used.(EB3)
i joined another firm and started off fresh using old PD, and EB2, which got ported
I had 2 RFE on my prior 485 FOR medicals and EVL. that i answered ( company didnt had issues as long as i was paying for it)
now How do i get my prior 485 to be merged, since its not an easy case, my new firm isnt willing to do so, can i raise SR/IO and try it? is it worth it
Have you asked your lawyer? Check with your lawyer first as you say it is a little complicated. You don't want to mess up this late in the process.....

Let me give you an example and you would understand my point. USCIS Customer Services Directorate received 16 million calls from the public and 300,000 from Members of Congress. Add to it, all other items people do to get attention for their case and think that by sending an email or a phone call from Senator or by a lawyer, the officer will realize his mistake and quickly open the file and approve it. If you look at the responses people post to their inquiries, you would see that most responses are standard. USCIS is not just approving 140K greencards but more than a million greencards, hundreds of thousands of H1 and other visa types, EADs etc...every year. Greencards do not get issued on the day date gets current. It is not a automatic process. There is lot of human work involved and many people do not understand that or spend time understanding it. They would rather waste their time either on useless task of tracking or calling customer service every single day.

The OP is great. He has created a new id to discuss L1 fraud. Will he be creating one id per issue... recapture, H1B abuse, outsourcing, backlogs?? wow!!!
Not sure why he wants his/ her identity covered up. This shows how good some of us are in trying to make noises in the dark and not doing anything about issues in hand.
In all, I still don't understand why L1Bs cannot work at Client site. I am sure that the L1 petitions specifically ask for Client site / work location. If Client site address is mentioned, the USCIS does approve the petition. If it is against law, they will not approve the petition. I know this for a fact since some of my friends are on L1.
Regarding my identity cover up... I have mentioned couple of times abt the seriouness of the situation as the other party is a multi billion dollar organisation, second please add all the reasons why ICE/USCIS/DOL provides anonymity and whitsle bowler protection to people who brings these kind of violations to their notice.
Regarding working at client site... Yes they do get approved for working at client sites BUT with the condition that they would be working directly under the suprevision of their managers and NOT the client managers (they don't qualify for consulting assignments). Also these L-1B visas are approved for working on speciality skills NOT on common technical skills (like java/.net/DBs/Prod Support etc). Next time read your friends L-1B petition carefully and you could find all these details over there.. also verify the L1 reform act of 2004 (published in this thread).
Regarding retrogression... I agree that L-1B visas are not impacting the same much and also I think if someone in L-1A LEGALLY qualifies for EB-1 there is nothing wrong in getting the GC, If we think thats not appropriate then we should bring this upto the law makers and get it rectified BUT fake EB1s should be notified to authorities.
We are fighting against a fraudulant activity by which our jobs (and hence our GCs) are jeopardized and its not a fight against fellow immigrant BUT a fight against the greed of these corporates to make money even by committing such fraudulant activities.. hope this clears the doubt.

Only thing I know is that if you come before me in the line I am affected. It is not a DMV line where every one will get their License, it is a ration line where the items are limited.
Call it selfish call it any thing else but these are the facts after being in the USA for last 12 years and two different labors.
You have every right to look after yourself. But it should not be at the expense of your comrades who are affected by this unjust system more than you are.
Solution: direct your ire against the system that is unjust to you. ( USCIS, DOL, Gov etc). That is what IV is trying to do. Let them give enough visa numbers for EB based applicants.
If many of the great leaders of the world were as selfish as we are, we would all be a herd of animals.

Godbless, I am sure you can get your post 6 years H-1B extension based on the Cornin and new Aytes memo of 12-5-2006. Can you ask your lawyer whether it is possible to file your H-1B extension after 01/26/2007 but BEFORE June 2007 or it must be filed before the expiry of your parolee I-94? Also, you said the Immigration Officer at the POE did not let you use your H visa but the AP. Is it because you showed him both of your H-1B visa and AP? If you did not show the AP, he would probably let you enter with the H-1B visa, right?
Sorry for my knowledge but why would anyone need an AP if he has ample time left on H1 ? Is it a rule that after filing I-485 , you have to have an AP to travel ?

I think you have a good case here....I really don't see why they can't hire EAD's. Especially because it is 'discriminatory' as per regs to do so. If the reason is something else, then they should say so.
Maybe they just want you to sue them and then declare bankruptcy..with all their sub-prime credit card exposure, they must be in bad shape..
