I have a question on your solution#4) "granting citizenship to people who have stayed in US for 10 years by rules to pay taxes". The 10 years ----are you talking about several years of study plus several years of working in US in H-1B visa ONLY or for any people who have legally stayed in US for 10 years??? I raise this question because I am curious to know whether I will fit this category. I was a foreign student in US for 10 years and pay foreign student tuition fee in full for 10 years. The first 6 years in several degrees and then back home and then come to US again for professional doctorate degree in 4 years. Originally I find employer to file me the H-1B visa but the quota for Master degree or above is full and then I back home until now. I am sure someone has similar situations to me!!
From other forum, someone said that it is extremely difficult to legalize the illegal aliens due to recent huge economic recession. But if each illegal aliens give non-refundable $5000 immigration entry fee to the country, the country will have about $60 billion fixed income. Then I immediately have thought about if our international students who have stayed in US for 5 years or above give more immigration entry fee to the country, the country will have tremendous cash flow into the economy and may help the economic crisis. Mumbai Consulate did not interview husband and myself. An Indian gentleman called us to the counter and told us that the VO had approved our H1B renewals and that we would receive the PP by courier the following day.

Did anyone see any Soft LUDs on their 485 or old EADs before their approvals/RFEs?
My PD is June 7 2006, not current. Yesterday, I had a soft LUD on my 485 and my first EAD. These two haven't seen any activity since early 2009, and I'm wondering if this means anything or if I'm reading into this a little too much.

Just got off the phone after speaking to my lawyer. In legalese talk (aka CYA), he said he can't comment on rumors. When I mentioned that this is posted on AILA, he reiterated that he can't comment on news/rumors unless it's posted on his firm's Web site.
And he also said no one in his firm is working this weekend to send in all applications on Sunday evening/Monday morning.

I dont think there is any issue with the way CIS allocates Visa. They clearly have specific definition and reservation when it comes to VISA categories. If you look in that aspect, EB1 comes first then EB2 and EB3. But this is very specific to VISA Category and does not mean the individuals. So If some one, who qualifies for EB2, but for some reason, he applies for Visa under EB3, it is not the fault of the system, it is the fault of the Individual. This includes me, since Iam May 2003, EB3-I. I do qualify for EB2. So I cant crib. If i want, I can change company and file EB2, for which I think, I am qualified or not apply under EB3 knowing the consequences until I find some one who can file my GC in EB2. When I file my GC under EB3, then in true terms, Iam degrading my self and i should face the consequences. Does it not make sense. So, I suggest work towards the immigration bill and try to make calls to get HR.5882 passed, Otherwise, I dont see any future for EB3. May be EB2 is better than EB3 in true definition, but that does not mean EB2 folks are better in anyway than EB3 folks. Hope u all agree.

1. DOS has to move fast in May to test if there are hidden demand (ppl who missed 07/2007 filing, porting, dependent filing). Those new filing cannot get be approved before October 2011. So they can move up to Nov/Dec 2006 safely in May. Also DOS/CIS, who communicate with each other for sure, will know they should process those pre-adjudicated cased first to clear the inventory.
2. In June, July, August, they could be cautious but still move ahead up to March 2007.
3. September is critical, as that time, if DOS doesn't want to waste any quota, (100% CIS cannot approve any cased filed in that month), they have to move to a point to get all quota used. Based on 12K/half year, or 12K/year from EB1, say 20K be safe this year from EB1. 7K from EB2 ROW as last year, 8K from EB3, 0 from FB (EB2 get only 10k/4 last year as 10K FB is divided by Eb1/2/3/4), and normal 2.8K for EB2 I/C each (6K total), there are total 41K possibly for EB2 I/C.
4. Porting (6K this year), New filing (ppl who missed 07/07 with PD before 07/07), could have a negative efffect
5. The inventory for EB2 I/C is about 34K before 07/2007 (based on DOS October/2010 and CIS inventory)

Which means that they know pending I 140 for EB1 in pipeline and they also know that average time to get approve new I 140 is X months ( 4 months ) so they know if person files in May 2011 chances are rare that he/she can get GC from 2011 quota.I am not saying is that applicant can't get it but when u look at I 485 complexity and add scrutinity on EB1 I 140 its more than 4 months to get GC from start to finish without any RFE.
That is why they are so confident to release quota now. which may bring date so much forward so that can attract new cases and move back dates to certain point in time. Specially this is how DOS does for all family based CP cases. When they think they have 10k visas coming they move dates to cover 15k out of which 12k may reply on time and they always have control to retrogress dates if they run out of visas.

Employer is tsill at liberty not to interview EAD holder. If you are not interviewed, hiring would not come into picture and hence this text of law in I-9 form is worthless for you for that position. This I-9 text will only cover the situation for the period after hiring not before hiring.

Why should I interfile? I am putting my energies into getting USCIS to follow the rules. It is the right thing to do, just because I am willing to wait for my turn, doesn't mean I will cede my position in the queue.
Also, I am trying to take recourse from the written laws, there is nothing that anyone can do (barring USCIS' own impediment to follow the law) to not "let that happen".

Moreover, I don't think that employers will employ substandard labor just because they are marginally cheap, because it turns out to be more expensive. In all the cases that H1-B and L1 pocket less money than their counterparts the booty goes to middlemen(both Indian and American bodyshps) and not the companies that ultimately use their skills.
You are wrong here. Do you know that companies like TCS/INFY/Wipro offer �blended rates� in the range of $20+/hr for keeping over 70% of staff offshore? Client directly benefits here. I have seen hypocritical companies that took tax benefits from local governments like cities and counties (which came at the expense of property taxes paid by residents of those localities) for job creation and then turned around and outsourced the very same jobs that they were supposed to create to TCS/Wipro/INFY etc., often dismissing the existing contractor pool/employees which involved people of all nationalities including H1-b workers like �TN Man� who couldn�t compete with the $30+ rates for the on-shore workers even if something was available from these vendors. Now to dump people at $30/hr rate, even though talent is locally available - like "TN Man", these vendors will abuse H1 and L1 by securing as many of these visas as they can( which were intended to bring the best and the brightest for american companies), causing Bill Gates to advocate for unlimited H1-bs when in reality, what he needs is a few thousand H1-bs which should be available in normal circumstances, had these companies not been poaching those visas.
So these offshore companies circumvented the prevailing wages through an industrial practice that should be considered �dumping�, where they dumped green-horns for the greedy clients, because the green-horns don�t have to go through any interviews in exchange of the very low rates. In this case, the people dismissed from the company/contractors were a lot more skilled, yet managers like me would be forced to start from scratch with the new pool, often resulting in delays for strategic initiatives at these companies, but the bean counters at the top never care, since their horizon is the next quarterly earning release, not what the company would do 2 years down the line (and some of these companies are the culprits behind financial crisis today with their very myopic thinking, just a sample was illustrated above)
The only jobs that were created in those localities due to such corporations in exchange for tax credits often were Indian Grocery shops opening in that locality to cater to those folks from offshore vendors. :D BTW, I don't have anything against them, I like Indian food.

I have news for you (and the certitude with which you make your claims here are laughable). Computer science graduation rates in US went up this year by 6-8%, because the visa caps since 2003 remained at 65000 instead of 195000 creating some demand here. I personally know kids who wanted to go to Computer science, but went for other areas like health care because of the lack of offshoring/H1 etc. If the crooked Indian offshorers and fly-by-night operators are not driving down the wages, more americans will go to computer science, as they would go for a career as MD or Pharmacist or lawyer (almost all those careers need at least 6-8 years of college). They also know that professional associations like AMA or APhA wouldn't allow importing foreign workers by corporations/hospitals on a scale that H1-bs are imported in IT area
Very sorry to disagree with you. Kids here have a lot more well paying choices for career and computer science is not really the glamour area for them. Where do you get 6-8% number from? is it Bachelors, Masters or PHD graduates? What percentage of this number is foreign students? in my experience there was a surge of foreign applicants even at Bachelors level during the same period.
Kids choices here are guided by their interest and career opportunities. And interest is the foremost criteria. Your thoughts about physicians or pharmacists are not apple to apple comparison. People have been sick through out the history of mankind and there has been increase in physicians and care providers propotional to population growth rate. There has been no explosive growth in those areas. IT/semiconductors/computers have gone through a period of explosive growth. That growth rate slowed with the burst of 2000-2001 and the H1 numbers reflect that. Why are H1 numbers not taken this year? It is simply because the market has slowed down.
Based on my experience, I wouldn't say that Indian kids have any special skills in maths or science compared to americans. Contrary to what you claim, people are aware of H1s and offshoring(may be so much on the exploitation of L1) as they talk to friends and family and guidance counselors at school. Most of the IT jobs were Indian H1-bs are employed doesn't even need computer science or engineering degree. Some of the best architects I have seen in IT didn't have a computer science major. A green-horn from TCS/INFY with a computer science degree and pretending to be an architect doesn't mean he is the best IT professional available in the market.
A computer science degree is not a mujst but it should be in related fields of science, math or engineering. can you show me a pharmacist or physician who is an architect ? The guy who is hiring a professional will determine who is the best suited for his needs? If the guy from TCS/Infy does not suit his needs he can find the best guy available to him. You can not judge who is best suited for all jobs available. And in this economy if a person's skill does not suit the job he is out of the door pretty quickly.

Real mature! You make shitty decisions of buying expensive homes, you don't own up your mistakes, you don't keep up your commitment of paying back the loan you have taken, you screw up people who ARE paying their mortgages, then blame the banks ALONE for the mess you are in!
What banks did was "predatory" lending. Now I would sympathize with if someone with no education to fall into such a mess and balme it on the lender. You and others like you who balme the banks all consider yourselves "higly educated" and "higly skilled". Hell you are even demanding congress to hand you a green card claiming to be one. But now that you have gotten yourself into a financial mess you blame the banks for all of your problems?

Then how is his decision to foreclose a "smart" thing to do? Last time I checked what he is trying to do is absolutely unethical! Nothing "wise" there!

a. People already working in US
