    Folks,

    I would like to run a questions by you guys/gals. I am getting ready to file my I-485 application. My lawyer requested that I find all copies of my I-20, OPT EAD, H1-B's etc. My question is do we have to submit copies of I-20, and OPT EAD for the Adjustment of status (I-485) stage ? Please let me know what you think ?

    I-20 is from a university that accept students in the US. The F1 student visa is issued based on the I-20.
    OPT EAD - Is one year of practical training that is allowed after graduation
    It would help if someone can put a list of all documents needed for 485 filing on this thread to help all such questions.

    ALBANY, Oct. 16 � The CNN anchor Lou Dobbs calls Gov. Eliot Spitzer �a genius.� But not in a nice way.

    �I was being about as facetious as one could be,� Mr. Dobbs said in an interview Tuesday as he prepared for his nightly broadcast, �Lou Dobbs Tonight.� For the last nine days, the show has included discussion of Mr. Spitzer�s plan to allow illegal immigrants to apply for driver�s licenses.

    Mr. Dobbs, a pinstriped journalist turned populist crusader against illegal immigration, is not a fan.

    �It�s an abuse of power!� Mr. Dobbs thundered. �He is being absolutely irresponsible. When the governor of New York embarks on this kind of irresponsibility, it is national news as far as I�m concerned.�

    And when Mr. Dobbs � whose broadcast is CNN�s second-highest-rated show � speaks, many people listen. His relentless mockery of Mr. Spitzer�s decision has thrust the driver�s license policy onto the national stage, helping fuel an uproar not only among New Yorkers, but among national groups opposed to illegal immigration as well.

    As it happens, Mr. Dobbs was recovering from a tonsillectomy when Mr. Spitzer announced the policy on Sept. 21. But the anchorman went on the attack almost immediately after going back on the air Oct. 8, saying it was �hard to imagine what this governor is thinking.�

    It only took him another week to conclude that Mr. Spitzer, in fact, was not thinking at all. �This governor is a genius,� he proclaimed disgustedly on Monday. �An overwhelming majority of New York voters oppose the governor, but he refuses to back down.�

    With the television set on mute, the scrunch alone of Mr. Dobbs�s brow conveys his belief that Mr. Spitzer�s new policy is, possibly, the dumbest idea in the history of dumb ideas.

    �I think he�s definitely had an effect,� said State Senator Martin J. Golden, a Brooklyn Republican who was on Mr. Dobbs�s show on Sunday to denounce the plan. �Everybody�s chiming in. I get e-mails from across the country because of Lou Dobbs. I got an e-mail from a soldier in Iraq saying, �Go for it, Golden, keep it up.��

    Mr. Golden is one of several New York elected officials � most of them with more experience on New York 1 than on CNN � who have been recent guests on Mr. Dobbs�s show. Many have expressed support for proposals by state lawmakers to overturn the license policy or to deny funding for it.

    But not everyone who goes on gets supportive e-mail messages.

    Jos� M. Serrano, a Democratic state senator who represents parts of Manhattan and the Bronx, appeared with Mr. Golden to defend Mr. Spitzer�s policy, but found himself under a verbal barrage from both the host and his fellow guest. �Oh my goodness, that was something else,� Mr. Serrano said. �I think it was my first time on national television. I wound up debating both of them � Lou paid very little attention to Marty Golden and instead just kind of dug in on me.�

    This next morning, Mr. Serrano said, his office was bombarded with angry e-mail messages from around the country.

    �One guy wrote, �We will derail the illegal gravy train from within,�� he said. �I don�t really know what that means. Another person said, �Go back to Mexico, you�re obviously Mexican.�� (Mr. Serrano is from Puerto Rico.) �I�m not na�ve, but I was still surprised at the level of ignorance,� Mr. Serrano said.

    (Mr. Dobbs�s correspondents have also stated on the air that illegal immigrants will need only a foreign passport to obtain a driver�s license, and that Mr. Spitzer�s policy was instituted through executive order, neither of which is true.)

    Mr. Dobbs�s guests and interviewees are typically opponents of the policy. A segment that Mr. Dobbs pitched on Thursday as �a lively debate� on the issue, for example, featured the host and two members of the State Assembly who oppose the governor�s plan, along with a viewers� poll on whether Mr. Spitzer should be recalled. (Ninety-seven percent said yes.)

    One person who has not made an appearance on Mr. Dobbs�s show, despite repeated invitations, is the governor himself. Christine Anderson, a spokeswoman for Mr. Spitzer, said scheduling problems had prevented the governor from appearing. The administration had made other officials available to Mr. Dobbs�s bookers, she said, including Michael A. L. Balboni, the governor�s top Homeland Security aide. But the show�s producers had declined.

    �We don�t really have a position about his show,� Ms. Anderson said. �That said, facts matter, and what we have endeavored to do throughout this entire debate is to make an argument about the safety and security benefits to doing this.�

    But Mr. Dobbs said that Mr. Spitzer, and Mr. Spitzer alone, is responsible for defending his new policy.

    �The man hasn�t shown the gumption to come on the air and debate the issue with me,� Mr. Dobbs said.

    If AILA is telling that means there is 50% chance of rumors becoming true. If the rumors are true then State Dept and USCIS mismanaged visa numbers. Anyhow wait and see couple of days

    But I can not help but notice the timing of priority dates becoming current and also these rumours.

    The priority dates became current right before the immigration bill was to be brought up for the second time in the senate. Now as the bill has been shot down, next day these rumours begin surfacing. Guess no need to keep us distracted anymore, so no need to go through the pain of getting bombarded with applications.

    Remember both are extraordinarily extreme measures. Make priority dates jump 5 years in one month and then retrogress them in the middle of the month.

    Call me wildly imaginative, but I can't help but think that maybe there are people in senior positions in USCIS who would be at home in NumbersUSA.

    VO doesnt keep your passport if a via not issued at the time of the interview . He gives it back after the interview. Once you receive the email , you have to go the VFS office and then had in the passport.

    My bad. I was thinking he/she got visa and waiting on PIMS verification. For PIMS verification, consualte keeps passport and issues visa after PIMS validates the I-129.

    Your job description can have a clause like 'Work location, Atlanta, but beneficiary will travel to various client locations within the country and outisde the country.' This is not an issue

    I just talked to them. Rep said they can not match vonage offer.... I am already paying teleblend around $16 per month. I see no reason why I should not pay $9 more to Vonage in order to get Unlimited India Calling plan. (As I also spend atlest $20 - 25 on reliance india call additonally.)

    any other person there who talked to teleblend?

    Final price for vonage would be $33.

    Does one need to be physically present in US in order to file I-485 application? I had already booked my travel to India on May 25th before I came to know that the my Priority Dates had become current. Will I need to be in US till I get the filing receipt? I was curious on how would UCSIS know that I'm out of country on the day of filing?

    I was thinking exactly like you until she educated me on this yesterday.

    The problem with the EAD is you are invoking AC21. There are several possible problems here including

    1. Complying with AC21 requirements of job code, 180 days after 485 RD, etc.

    2. Invoking AC21 without 140 approval. This is not against the law, but is risky in case of a 140 RFE.

    There are more reasons, but these ought to provide enough clarity on the problem. It is in the employer's interest to ensure that the candidate does not have any such issues; issues which will lead to termination of employment. The Recruiter cannot check DOL job codes and USCIS documents. That is the job of Legal which means $$$.

    So if the hiring manager does not have a budget for these extra costs or if he has an equally good candidate who is a GC holder or a citizen, it is easier to go with him or her.

    Agreed. But EAD doesn’t apply to EB based immigrants alone. There are hundreds of thousands of family based immigrants who use EAD until their status gets adjusted and I-140/AC21/180 days etc. are not applicable to them. Same applies to the spouses of EB applicants. In such cases it’s a waste of time/money for the company to consult with the legal department.

    I believe it’s the responsibility of the EAD holder to communicate what he expects from the new employer (like AC21) after which the company could decide whether to go with the legal department or not. Just assuming that all EAD cases fall under I-140/AC21/180 days etc. is plain ignorance.

    You stand is understandable, but I still will urge you to join me. It is of course not illegal but unfair towards the people already in EB2 line. If there were no limits on visas, it will not have been an issue to begin with. Think about the depth of the issue.

    I am not arguing or obstinately stating my view. I am genuinely confused.

    I am not sure how it is unfair on EB2. Didn't these folks apply for GC before us legally and stand in line sincerely (no labor subs) AND gather pertinent work exp and education?

    I understand you are working on getting the numbers. I would wait to hear from you with those numbers.

    It is one thing to feel wronged seeing a few examples of people abusing the porting but quite another to have a lawsuit alleging that this is a widespread activity and it is causing grievous delays for the ones waiting in EB2. I really don't believe it and feel it is insulting to a large majority of highly skilled and hard working immigrants who have/will legally port their EB3 PDs to EB2.

    why do you keep parroting the pro USCIS, pro -antiimmigrant line all the time?
    there are times when your realism makes sense, then there are others when it's plain silly.
    this was not a mistake. this was not an accident.
    civil servants do not show up on weekends by accidents. and they do not do 6 mnths of work in 15 days by mistake.
    it was intentional, directed and planned.
    you can believe whatever motives you want and you can sympathize with uscis till kingdom come. but pleaaasee don't tell me it was a random event, some act of god that is our destiny or such crap. please!

    I wish USCIS could stand out and answer those questions... do whatever they can to clarify those "rumors". :confused:

    Thanks folks for your wishes. I had not been active on the volunteering side due to multiple reasons and other day to day challenges and career.

    I agree with a lot of people in the community that it is a challenge to balance a challenging personal life, especially in a country like America where regular day to day life poses many challenges.

    In the green card process, the challenge is just not about one needing a job to fulfill day to day needs but to secure a future for him/her and family.

    A lot of people I have come across through IV have been absolutely amazing in stepping up and doing what they do and this platform provided by IV (Aman, Pappu, Jay etc..) has been a blessing for all of us.

    I have written to IV core that I will continue to support IV and its activities.

    Got an email from USCIS stating that there is an change in status... This email showed new status as Card Prodn Ordered...

    This was early evening 22'nd Oct.... Got two emails - one for me and one for my wife... exactly identical email.

    Then later at night (closer to midnite NSC time i think), i received the same two emails for me and my wife again.... not sure why.

    Since then no other emails.... So far, i have only recvd CPO email.... no other emails at all...

    Donot worry about 2 emails. That normally happens for alomost any approval email from USCIS. I always got 2 emails from USCIS in approval of my every case like h1b ext, 485 etc..
    You may not receive any more email from USCIS about your 485. But USCIS will send 485 approval courtesy copies to you and originals to your attorney. So please contact your attorney after 3 or 4 business days and collect your original i485 apporvals. You will receive your green cards with in 1 week. I received CPO mail on oct 17th and received green cards on oct 24th.

    Please let me know if you need any more info.
