i do not understand how overstaying and transit visas are related.
the TV allows you to "walk from one gate to another" in the international transit area...that's all. you cannot walk OUT anyway without crossing immigration- and if you want to do that- you always need a visa. this new visa, confers (for 90 bucks per person) the right to walk to your plane- sometime the right to walk off and back on to your plane...what a joke!

It is received date stamp, what they do after receiving. They do it immediately on the same day.
(area code 202) 663-1541 still reading June Visa bulletin. Did they revert back?
If its mailed out today, then you are ok. Its the POSTMARKED date that is seen. So even if it reaches there in July, as long as it went OUT today, they will have to accept it under June's batch of applications coz it is postmarked in June (june 29).

It looks like USCIS is interpreting the rule the way they like.
It looks to me that they have lots of pressure from big companies and they are approving their applications in Particular. e.g., EB2-I with PD of 2006 are getting approvals, however EB2-I with PD in 2004 are still waiting.
There is no FIFO here and there is no clear rule. They can do whatever they like.
I am EB3-I too, plz don't take me wrong.

If they are indeed genuine then there should nothing be worried about. They would come out clean. Remember, the whole labor certification is to protect the interest of American people and not foreign workers like you and me.
If DOL scrutinizes such petitioners more than others, then its good. That will weed out pretenders; but also on the other hand, that will put genuine candidates petiotions into a pre-adjudicated state.

for all those whose lawyers allow multiple filings: what are you filling in for I-485 Part 3 section A "Have you ever before applied for permanent resident status in the U.S"?
In my case both applications are proceeding in parallel and I dont know which lawyer will end up filing first!
The one you apply next should should have the option checked.
Word of advice:
Understand the full implications if you want to file 2. I have gone into its details over the past week and this weekend, and would not advice someone to do it just for the heck of it. You should have VERY genuine reasons for it due to some risks involved. This is a grey area and there is no law for it or against it. There can be some risks and advantages.

Well suppose they reject your 485 for lack of Initial Evidence then you are in some trouble. The people who applied prior to new Memo was passed had there applications receipted even without EVL. What will happen after the Memo is passed ...can't say. I think EVL is considered Initial Evidence. Thats my guess.

When you buy a home you sign a contract saying you will pay the loan amount at the end of the loan term with interest. There was a commitment made. And you are saying people who walk away without fulfilling their obligation are smart? Fool!

Spatial, I agree with your views. There is nothing in INA which clearly talks about how the spill over should be allocated. USCIS is acting on its own whims and fancies. In last months' visa bulletin they mentioned questions were asked on how the spill over was allocated and decided to make it horizonal instead of the historical vertical spill over. So I am sure we should get some concrete answer how they decided to change it. Based on what ? which clause of INA states that ? I think we should all write letters to Mr. Oppenhiem demanding explanation on the same.

All I 94 - does this mean all the I 94's you ever had or the I 94 that currently is in your possession.
I do not have copies of all the I 94's that were issued to me since my stay in US .. any body any thoughts?
Be ready with the following supporting documents. My attorney asked the following:
1. Personal Details -
(Travel Plans in the next 3 months, Moving Plans in the next 6 months, Contact Information, Passport and I-94 info, Employment Hisotry - Last 5 years+ Last job ouside US, Residence History - Last 5 years + last residence outside US, LC, I-140, EAD and details, and a few other questions, etc)
2. Passport copies- all pages, current, all old.
3. All I-20, I-94, I-797, LC, I-140 copies
4. Birth Certificates or Birth Affidavits
5. Marriage Certificate or Marriage Affidavits -
