Yes I had one pending and no RFE was received for either. My lawyer is expecting a notification from USCIS stating the second one is withdrawn.

I think the fact that you had same A# helped you despite multiple filings. There are cases of people where even though they have declared their second application, USCIS assigned them a second A# number.

that the offer was taken back based on EAD status.
anyway, I understand the lawyers need to be paid! I just want them to stop changing the rules in the middle of the game. Its been a long frigging wait and now this.
My hope is that there was some misunderstanding and that they will just quietly remake the offer and give me the job back.
At will employment does not mean you can discriminate. Its akin to firing someone if they get pregnant or me leaving because I did not like the skin color of my boss. Both are discriminatory if they can be proven. In this case it can be.

Flying through Asian Countires is not an option for people residing in East Coast. I am travelling to India in the next week Via Amsterdam. I am told by the consulate that we do not need Transit Visas. My H1B Visa is expired and I am travelling on AP. Did any one hear differently?

The reason transit visas are required in the UK is that many passengers with an intention to transit the UK have stayed. The transit visa was introduced as a way of making sure (as much as possible) that the passenger has the intention and the ability to transit the UK and to enter a third country.

That if eb2 numbers are not filled then they automatically get allocated to eb3 so why to have portability to eb2.

This is ridiculous; all I see is unnecessary hurdles being produced � I see efforts of discouragement towards coming to this country on H1B. First they suddenly start auditing 60% PERM cases and now suddenly delaying visa unreasonably�increasing Visa numbers and making Green Card processing faster is aside, we are facing other problems.
I have started speaking with senior people at DOS. On a purely procedural level I don't see why an H1 applicant who may already be in the US is not 'security cleared' at the time of giving the I-797 approval. Totally ridiculous.

It is not true that all the H1bs are creating jobs. For one example I worked in a big garment company and they laid off hundreds of people(around 800) 4 years back and did offshoring 90% with 10% H1b and L1 to Infosys. This would have created less than 10 new admin jobs for setting up office here but it displaced 800 jobs plus all the new projects(jobs) go to Infosys and US government lost millions in taxes for a private company to save a few million dollars. But if a H1b is a real innovator or investor then he could create scores of new jobs but those guys are very less. They should be identified and rewarded by faster GC process.
But real intention of H1b when it was created was to fill shortage of skills but not for competing with citizens in rate. If the real intention is to compete globally then that needs to be revealed while lobbying with Senators. There is nothing wrong with immigrants or H1b persons. Most abuses are done and enouraged by employers. Corporations prefers a person always to be in H1b so they want more H1b quota and less gc so that they can exploit people.
Basically H1b numbers and offshoring needs to be increased when demand is high(Really it was needed on 1999 and 2000) and it needs to be decreased when demand is low. Also today also there is shortage of skills in a few areas. System should handle those also.
Well there are different examples you can cite all the time to turn the argument in your favor. By themselves H1Bs in that status can not create jobs, because they are bound to the employer. However there is no denying that a lot of them such as those who graduated from US universities with masters degrees, those from IIT or IIMs are smart and bright individuals. I know at least 2 Indians , family friends that after getting their green cards, started companies on their own and now employ hundreds locally if not thousands.And let me tell you these are not desi consulting cos. The very premise of tying an H1 to employer is wrong, not the individual by himself. Instead if there is point/skill based immigration system then it will ensure only the brightest will come inside the country. Currently the decision to hire the immigrant rests with an employer and hence we see systematic corruption to some degree.
Also what I said was companies are profit oriented business entities. Of course they will want to hire people who best benefit their business. Nobody is stopping a local from proving that.

I do have a difference of opinion here. Most people come for their questions and discussions rather than advocacy everyday. Thus forums are important. We already have lot of space allocated for what IV is on the homepage.
Pls suggest what changes you think will get us more visibility and confidence with new members.

Hi guys
Just now (12.30 PM EST) I got a mail from USCIS saying your application has been approved. I didn't do anything (never opened SR or contacted Senator) but last week I did had an info pass appointment which was useless. MY PD was Feb 2005 EB2 INDIA (The fun part is My AP and EAD are still pending for over 4 months)

IF they were PD's we shouldnot be seeing anything after Jul 2007 [as those were the farthest PD's ever reached].
Seems logical, but on the other hand if that were to be the case, then why isn't there a spike in June-July '07 to reflect the deluge of 485 filings?

There are laws and there are exceptions. Basically there are no Laws when it comes to Immigration. USCIS/DOS can do whatever they like.
Look at Jul'2007, people with EB3 PD of 2004 got approved and people with 2001 are still waiting.
Look at EB2 approvals these days. People with 2006 PD are getting approved and people with 2004 PD are still waiting.
Can somebody explain how PD in each VB goes backward? Is it possible to get new applications with older PD in between? Don't they have computers with all the data where they can see how many applications are pending?
Howcome they were giving unused numbers to EB3 till last year and how come they changed the interpretation this year. The rule didn't change, they simply changed their interpretation of it.
If EB3 would have known about this new interpretation then they would have never applied in EB3 category.
Bottomline is there are no rules. USCIS/DOS is doing whatever they like and playing with our life. Nobody knows how many applications are pending. Nobody can predict the VB movement, it goes forward and backward. We cann't plan our lives and live in limbo all the time.

My lawyer's office said they are not going to take any chance and mailing all the applications (that are ready to go) on monday morning.
